Live-In Relationship Rights in India: Supreme Court Protection for Adult Couples
Live-in relationships are becoming increasingly common in India, especially among young adults who choose independence and partnership over societal pressure. Despite social challenges, the judiciary in India has consistently upheld the rights of adult couples to live together without fear.
This blog explains the legal rights of live-in couples, the role of the Supreme Court and High Courts, and how Delhi Law Firm helps couples seeking police protection and legal assistance.
Live-In Relationship Is NOT a Crime: Supreme CourtтАЩs Clear Stand
In the landmark judgment S. Khushboo vs. Kanniammal, the Supreme Court of India held that:
A live-in relationship is not a criminal offence.
It cannot be labelled тАЬimmoralтАЭ to initiate criminal action.
Adults have the right to choose their partner and live together peacefully.
This judgment set a strong foundation for the protection of live-in couples across the country.
High Courts Reaffirm Protection for Adult Couples
Several High Courts тАФ including the Punjab & Haryana High Court, Rajasthan High Court, and Allahabad High Court тАФ have repeated the same principle:
If two consenting adults choose to live together, it is their fundamental right.
The State has a legal obligation to provide police protection.
Family objections, threats, or social pressure cannot override constitutional rights.
These decisions ensure that live-in couples are protected under the Constitution, especially under Article 21 (Right to Life and Personal Liberty).
Why Do Live-In Couples Need Protection?
Despite these legal safeguards, many couples still face:
Family opposition
Honour-based threats
Harassment and social pressure
Threats of violence or forced separation
In such situations, the law empowers couples to seek immediate police protection.
How to Seek Police Protection in a Live-In Relationship
If a couple feels unsafe or threatened, they can quickly submit an application to:
SP (Superintendent of Police)
SSP (Senior Superintendent of Police)
SHO (Station House Officer)
Women Helpline / Police Control Room
Police officers are required to act promptly to ensure the safety of the couple.

The Supreme Court of India, on 6 November 2025, delivered a historic decision that will reshape the countryтАЩs arrest procedure and significantly strengthen the constitutional rights of every citizen.
In the case of Mihir Rajesh Shah vs. State of Maharashtra (2025), the Court ruled that police must mandatorily provide written grounds of arrest to the accused at least two hours before being produced for remand before a magistrate.
This ruling applies nationwide, covering all offences under the Indian Penal Code (IPC) earlier and now under the Bharatiya Nyaya Sanhita (BNS), 2023.
ЁЯФ╣ Why This Ruling Matters
For decades, IndiaтАЩs arrest procedures have faced scrutiny for lack of transparency. Many accused individuals often claimed they were not informed of the actual grounds of arrest тАФ weakening their ability to defend themselves effectively.
With this ruling, the Supreme Court has now transformed this practice into a clear constitutional requirement, safeguarding the fundamental rights guaranteed under:
Article 21 тАФ Right to Life and Personal Liberty
Article 22(1) тАФ Right to be informed of grounds of arrest
This makes the тАЬwritten arrest reasonтАЭ not just a procedural formality, but a mandatory legal right.
ЁЯФ╣ Key Highlights of the Judgment
1. Written Grounds of Arrest Now Mandatory in Every Case
Regardless of the nature of the offence тАФ theft, economic offence, cybercrime, accident, or any other тАФ the police must now provide a written document explaining why the person is being arrested.
2. Information Must Be Given in a Language the Accused Understands
The Supreme Court made it clear that the grounds must be provided in a language comprehensible to the accused тАФ such as English, Hindi, or any regional language.
3. The тАЬTwo-Hour RuleтАЭ Before Remand
The written grounds must be provided at least 2 hours before producing the accused before the magistrate.
This allows time for:
Understanding the allegations
Consulting a lawyer
Preparing bail or remand arguments
Preventing one-sided remand hearings
4. Exceptions for Emergency Situations
In rare circumstances (such as catching someone red-handed), immediate arrest may occur without the written document.
However, the written grounds must still be given before remand.
5. Arrest Without Written Grounds May Be Declared Illegal
Failure to provide the written arrest reason or providing it late may result in the arrest being declared illegal, and the accused may be released.
ЁЯФ╣ Impact Across India
The Supreme Court ordered this judgment to be circulated to:
All High Courts
State Home Departments
Police Departments
Investigating Agencies (CBI, ED, NIA, etc.)
The ruling is expected to:
Improve police accountability
Prevent arbitrary arrests
Strengthen fundamental rights
Make remand hearings fair and transparent
ЁЯФ╣ A Step Toward Transparent Policing
This judgment sets a new standard for due process in India.
By ensuring that every person knows exactly why they are being arrested тАФ and by giving them time to respond тАФ the Supreme Court has reinforced the value of liberty and the rule of law.
